Tomocreate Inc. ("we", "us", "our") is a creative company. We operate tomocreateinc.com and offer products and services including but not limited to: software applications for macOS and iOS, audio plugins and effects, motion graphics templates and visual effects tools, video production and creative services, DJ and live performance services, digital downloads, and any other products or services we may offer from time to time. 3. Information We Collect
We collect information only when necessary to provide our services:
Contact & Quote Forms
- Name, email address, and message content you submit
App & Plugin Purchases
- Email address (for license delivery)
- Payment is processed by Stripe — we do not store your card number or payment details
License Management
- Email address, serial key, device identifiers (up to 2 registered devices), and activation timestamps
Mailing List Registration
- Email address, IP address (for spam prevention and legal compliance), sign-up timestamp, and explicit consent record
Website Analytics
- We use Google Analytics 4 to collect anonymized usage data (page views, session duration, general location). No personally identifiable information is sent to Google Analytics.
Part107 Prep (iOS) — Study Data via iCloud
The Part107 Prep iOS app uses Apple iCloud (CloudKit Private Database) to sync your study progress between your devices. We do not collect, transmit, or store any personal data on our servers from the app.
What is stored locally and synced via iCloud:
- Study card review state (correct/wrong counts, Leitner box, next review date)
- Bookmarked cards, struggling-card flags, and language preference
- Optional exam-date setting and last-seen-version metadata
How iCloud sync works:
- Data lives in your iCloud Private Database — accessible only to your Apple ID
- Tomocreate Inc. has no access to this data and cannot read it
- When you sign out of iCloud or disable iCloud for the app, data stops syncing (local copy remains on the device)
What we do NOT do:
- We do not require an account, email, or sign-in for the app
- We do not include third-party analytics, advertising, or tracking SDKs in the app
- We do not transmit any data from the app to our servers (the only exception is anonymous fetching of optional content updates from a public CDN, with no identifiers)
- We do not associate device identifiers, IP addresses, or usage patterns with you
App Pro (In-App Purchase): The app offers a one-time Non-Consumable IAP processed by Apple. Apple handles all payment data; Tomocreate Inc. only receives an anonymous transaction signal from Apple StoreKit to unlock features. See Apple's Privacy Policy.
Location Data (32&0 Weather Widget)
The 32&0 iOS app uses your device's precise location to display local weather information in its Home Screen widget.
What we collect:
- Your device's current latitude and longitude (precise location)
How we use it:
- Your coordinates are sent to the Open-Meteo API (open-meteo.com) to retrieve current weather data for your location
- The retrieved data (current temperature, weather code, daily high/low) is displayed in the app and widget
What we do NOT do:
- We do not store your location data on any server
- We do not retain your location data beyond the current weather query
- We do not associate your location with any personal identifier
- We do not require you to create an account or sign in
- We do not track your activity across apps or websites
- We do not share your location data with third parties other than Open-Meteo for the sole purpose of weather retrieval
You can revoke location permission at any time via iOS Settings → Privacy & Security → Location Services → 32&0.
Location & AI Data (PowdersNow USA)
The PowdersNow USA iOS app uses your device's location and AI services to recommend ski resorts and plan mountain trips.
What we collect:
- Your device's current latitude and longitude (to find nearby resorts and calculate distances)
- A randomly generated device identifier (UUID) stored locally on your device — used to manage subscription status and AI usage quotas
- AI usage counts (number of AI Smart Search and AI Concierge requests per month)
How we use it:
- Your coordinates are sent to the Open-Meteo API to retrieve weather forecasts and snow depth estimates for ski resorts
- Your coordinates are used locally on-device to calculate distances to resorts (never stored on our servers)
- When you use AI Smart Search or AI Concierge, your text input and approximate location are sent to our server, which forwards the request to Anthropic's Claude API for processing
- The U.S. Energy Information Administration (EIA) API is used to retrieve regional gasoline price averages for cost estimates
What we do NOT do:
- We do not store your location data on any server
- We do not retain AI conversation content after processing — requests are stateless
- We do not associate your device ID with any personal identifier (name, email, etc.)
- We do not require you to create an account or sign in
- We do not track your activity across apps or websites
Third-party services used by PowdersNow:
- Open-Meteo — Weather and snow depth data (receives only coordinates)
- Anthropic Claude API — AI-powered resort recommendations and trip planning (receives your search text and approximate location, processed statelessly)
- EIA API — U.S. gasoline price data (no personal data sent)
- Supabase — Subscription status and usage quota management (stores only device UUID and usage counts)
You can revoke location permission at any time via iOS Settings → Privacy & Security → Location Services → PowdersNow USA.
AI Image Analysis (Frigo & Galerie)
The Frigo and Galerie iOS apps use AI to analyze photos you take within the app.
What we collect:
- A randomly generated device identifier (UUID) stored locally on your device — used to manage subscription status and AI usage quotas
- AI usage counts (number of scans per month)
How we use it:
- Frigo: When you photograph your fridge, the image is sent to our server, which forwards it to Anthropic's Claude API for ingredient recognition and recipe generation. The image is not stored after processing.
- Galerie: When you photograph an artwork caption, the image is sent to our server, which forwards it to Anthropic's Claude API for OCR, translation, and artwork identification. The image is not stored after processing.
What we do NOT do:
- We do not store your photos on any server — images are processed statelessly and discarded
- We do not associate your device ID with any personal identifier (name, email, etc.)
- We do not require you to create an account or sign in
- We do not track your activity across apps or websites
- We do not use your photos for AI model training
Third-party services:
- Anthropic Claude API — AI image analysis (receives your photo, processed statelessly, not retained)
- Supabase — Subscription status and usage quota management (stores only device UUID and usage counts)
MicroBooks Solo (macOS)
MicroBooks Solo is a local-only macOS bookkeeping application. It does not collect, transmit, or store any user data externally.
- No account registration required
- No network communication — all data stays on your Mac
- No analytics, tracking, or telemetry
- No cloud sync — data is stored locally via SQLite (SwiftData)
- Financial data never leaves your device
TranceMIDI (macOS)
TranceMIDI is a local-only macOS application for designing trance track arrangements and exporting MIDI files. It does not collect, transmit, or store any user data externally.
- No account registration required
- No network communication — all data stays on your Mac
- No analytics, tracking, or telemetry
- Project files (.tma) and MIDI exports are stored locally only
- License verification via Tomocreate Hub (optional, see Hub privacy section)
4. How We Use Your Information
- To respond to inquiries and deliver quotes
- To fulfill orders and deliver license keys and download links by email
- To manage plugin license activation and device registration
- To send product updates and announcements (only to subscribers who have opted in)
- To prevent fraud and comply with applicable laws
- To improve our website and products using aggregated analytics
We do not sell, rent, or share your personal data with third parties for marketing purposes.
5. Email Marketing — CAN-SPAM / GDPR
We only send marketing emails to people who have explicitly opted in by checking the consent box on our sign-up form. Every marketing email includes a clearly visible unsubscribe link. You can unsubscribe at any time and we will stop sending emails promptly.
Our emails identify us as the sender (Tomocreate Inc.) and include our contact address. We do not use deceptive subject lines or misleading sender information.
Transactional emails (license keys, download links, order confirmations) are sent regardless of marketing preference, as they are necessary to fulfill your purchase or request.
6. Payment Processing
All payments are processed by Stripe, a PCI-DSS compliant payment processor. We never see or store your credit card number, CVV, or full payment details. Stripe may collect and process payment data according to their own Privacy Policy.
7. License Management
When you purchase an AU plugin, we generate a unique serial key (format: TCRE-XXXX-XXXX-XXXX) and associate it with your email address in our secure database. Activating the plugin on a device records that device's identifier. You may activate on up to 2 devices. You can deregister devices at any time from your account page.
License data is retained for as long as your license is valid. You may request deletion by contacting us, but note that deletion will revoke your license.
8. Third-Party Services
We use the following third-party services to operate our business:
- Supabase — database and storage (US region)
- Resend — transactional and marketing email delivery
- Stripe — payment processing
- Vercel — website hosting and serverless functions
- Google Analytics 4 — anonymized website analytics
- Cloudflare Turnstile — bot protection and abuse prevention
- Open-Meteo (open-meteo.com) — Weather data API used by the 32&0 iOS app. Receives only latitude and longitude (no personal identifiers). Open-Meteo's privacy policy.
Each of these services maintains its own privacy policy and data handling practices.
We use Cloudflare Turnstile to protect our website from bots and abuse. Turnstile may collect information such as your IP address, browser characteristics, and interaction patterns to verify that you are human. This data is processed by Cloudflare, Inc. in accordance with their Privacy Policy.
9. Data Retention
- Mailing list subscribers: Retained while subscribed. After unsubscribing, your address is marked as unsubscribed and no longer used for marketing. Complete deletion is available on request.
- License data: Retained for the lifetime of your license. Deletion requests will revoke the associated license.
- Contact form submissions: Retained for up to 1 year for reference, then deleted.
- Analytics data: Governed by Google Analytics retention settings (default 14 months).
10. Your Rights — GDPR
If you are located in the European Economic Area (EEA), you have the right to:
- Access the personal data we hold about you
- Request correction or deletion of your data
- Object to or restrict our processing of your data
- Withdraw consent at any time (without affecting lawfulness of prior processing)
- Request a portable copy of your data
- Lodge a complaint with your local data protection authority

11. Cookies
We use essential cookies required for site functionality (e.g., admin session management). We also use Google Analytics cookies to understand site usage patterns. Analytics cookies are anonymized and do not personally identify you.
You can disable cookies in your browser settings, though some site features may not function correctly.
12. Changes to This Policy
We may update this policy from time to time to reflect changes in our services or applicable law. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of our services after changes constitutes acceptance of the updated policy.
